I understand that my participation in the Chino Hills Wine Walk Program, Concert Series, or any other special event (the “event/program”) for which I am volunteering exposes me to the risk of personal injury, death, communicable diseases, illnesses, viruses, or property damage. I hereby acknowledge that participation in the event/program is voluntary, and I agree to assume any such risks.

To the maximum extent permitted by law, I hereby release, discharge and covenant not to sue the Chino Hills Community Foundation, the City of Chino Hills, or any of their respective officials, officers, employees and/or agents (collectively, the “Released Parties”) for any injury, death, damage, or loss arising out of, or in connection with, my participation in the event/program from whatever cause, including the active or passive negligence of the Released Parties or any other participant(s) in the event/program.

The parties to this agreement understand that this document is not intended to release any party from any act or omission of “gross negligence,” as that term is used in applicable case law and/or statutory provision. In consideration for being permitted to participate in the event/program, I hereby agree, for myself, my heirs, administrators, executors and assigns, that I shall indemnify and hold harmless the Released Parties from any and all claims, demands, actions, or suits arising out of or in connection with my participation in the event/program.

An inherent risk of exposure to COVID-19 exists in any public space where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. By participating in this event/program, I voluntarily assume all risks related to exposure to COVID-19.

I agree to be photographed or videotaped, and release the use of the photographs and videos by the Chino Hills Community Foundation for publicity in the Chino Hills Community Foundation and/or the City of Chino Hills publications and other public information tools.

I HAVE CAREFULLY READ THIS LIABILITY RELEASE/HOLD HARMLESS/PHOTO RELEASE AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT IT IS A FULL RELEASE OF ALL LIABILITY AND SIGN IT ON MY OWN FREE WILL.
